Welcome to Powercases Canada online store operated by Powercases Inc. The following are the Terms and Conditions that apply to you in buying on our site. By shopping on this site, you agree to be bound by its terms of use and agree to comply therewith. We reserve the right to amend these terms and conditions from time to time without prior notice. Users of the site are advised to review these Terms and Conditions on each visit to be aware of changes, if any, that may have been made since a previous visit.

USE OF THE SITE

The site allows you to shop online. However, you may not do so if you are under the age of 18 or otherwise not able to form legally binding contracts. For you to complete the payments and shipping registration process, you must provide your full legal name, current address, a valid email address, and any other information needed to complete the shipping process.

ELECTRONIC COMMUNICATIONS

When you use the site, you are communicating electronically with us. You accept that all agreements, notices, disclosures and other communications that we provide you electronically satisfy any legal requirements that such communications be in writing.

PAYMENTS  

All payments on the site must be made specified credit cards, PayPal or Apple Pay. Products will not be shipped until payment has been received by Powercases Canada.

LIMITED PRODUCT WARRANTY

All products carry a 1 year replacement warranty if the product is proved to be defective. If you believe that a product is defective, please contact us at info@powercases.com with details of the product and the defect. 

Defective products will be replaced free of charge or, if the product is no longer available, a refund equal to the original purchase price of the product will be issued.

Powercases Canada liability for product warranty claims is limited to the original purchase price of the product. No claims for losses incidental to the use of the product will be entertained. We will not be liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data, arising about the use of a product acquired on the site.

RISK OF LOSS

Risk of loss and title for items purchased from the site pass to you upon delivery of products to the common carrier.

PRODUCT DESCRIPTION

We make every effort to clearly describe the characteristics of each of the products on our site including features, benefits, performance and technical specifications as may be applicable in each circumstance.  However, we do not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. Product pictures are intended to present a fair representation of actual products. However, we do not guarantee an exact match between the image and the actual product.

If you believe a product you have purchased is not as described, you may return it in unused condition as described under REFUND POLICY.

FACEBOOK PAGE

Powercases Canada maintains a corporate page on Facebook for branding and product display purposes. Visitors to that page may submit reviews, comments, videos pertaining to products offered for sale on this site. Powercases Canada has the right but not the obligation to remove any content or activity.  Powercases Canada does not take responsibility and assumes no liability for any content posted by you or any third party.

PRODUCT PRICING

The price displayed for products on our site represents the full retail price we ask for the product. We reserve the right to change this price from time to time in accordance with supply/demand and competitive conditions in the market. We also give notice that we may offer products in combination at a collectively reduced price in relation to the aggregate price for products acquired individually. Further, from time to time we may offer products at discounts from the stated price to support marketing initiatives and/or seasonal retailing conditions.

ACKNOWLEDGEMENT OF RIGHTS

All rights, titles and interests, including but not limited to intellectual property rights on the site are the property of Powercases Canada. Use of the site does not convey any interest therein to you.

FRAUD

Activities that appear to be fraudulent are monitored on the site. We will apply all remedies available to us at law and will aggressively pursue our legal rights against third parties engaged fraudulent activities.

NO-WAIVER

Failure of Powercases Canada to insist upon strict performance of any of the terms, conditions and covenants hereof shall not be deemed a relinquishment or waiver of any rights or remedy that the we may have, nor shall it be construed as a waiver of any subsequent breach of the terms, conditions or covenants hereof, which terms, conditions and covenants shall continue to be in full force and effect.

DISPUTES

Any dispute or claim relating to the purchase of a product on the site shall be resolved by binding arbitration rather than by the court except qualifying claims may be pursued through small claims court.

The Federal Arbitration Act and federal arbitration law apply to all claims made pursuant to business transacted on the site except for qualify small claims.

APPLICABLE LAW

All the Terms and Conditions set out herein are subject to the laws of Canada.

If any provision of these Terms and Conditions is found invalid or unenforceable pursuant to any judicial decree or decision, such provision shall be deemed to apply only to the maximum extent permitted by law, and the remainder of these Terms and Conditions shall remain valid and enforceable according to its terms.
